BHANWAR SINGH Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This criminal misc. petition under Sec. 482 Crimial P.C. has been filed by the petitioners being aggrieved with the order dated 16.4.2014 passed by the Chief Judicial Metropolitan Magistrate, Jodhpur Metropolitan (hereinafter referred to as 'the trial court') in Criminal Case No.19/2014 whereby the trial court has refused to extend the bail of the petitioners and summoned them through warrant of arrest.

(2.) Brief facts of the case are that an FIR No.209/2013 has been registered at Police Station, Sardarpura, Jodhpur Metropolitan against the petitioners and their son Mangu Singh for the offences punishable under Sections 498-A, 304-B.I.P.C. and for the offence punishable under Sec. 4 of Dowry Prohibition Act.

(3.) After investigation, the police has proceeded to file charge sheet against Mangu Singh for the offences punishable under Sections 498-A, 304-B and 201 I.P.C. and under Sec. 4 of the Dowry Prohibition Act, however, has filed charge sheet against the petitioners only for the offence punishable under Sec. 201 I.P.C.
