JUDGEMENT

(1.) By the impugned order dated 24.08.2011, the defendant's application under Order 7 Rule 11 CPC was rejected by the learned trial court, with the following observations:--

(2.) In view of the suit having been restored by the learned trial court, the present revision petition has become infructuous. However, the defendants will be able to raise objections again before the learned trial court in the suit restored by it and appropriate issues will be framed accordingly. With these observations, the present revision petition is disposed of Copy of this order may be sent to the concerned parties and the learned court below forthwith.
