MOOL SINGH & ANR Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) MOOL Singh, his two sons Devendra Singh, Lal Singh and his wife Kanwar @ Shrey Kanwar and one Shankar son of Madan Singh, were sent for trial in a case arising out of FIR No. 312/04, registered at Police Station Neem Ka Thana, District Sikar, for the offence under Sections 147, 148, 149, 307, 302 and 341 IPC.

(2.) LAL Singh and Shankar were found to be delinquent juvenile in conflict with law and were sent for trial before the concerned Juvenile Justice Board.

(3.) REMAINING three appellants, namely Mool Singh, his son Devendra Singh and Smt. Shrey Kanwar wife of Mool Singh, were tried by the court of Additional Sessions Judge (Fast Track) No.2, Sikar, Camp at Neem Ka Thana, Headquarter Sikar. The trial court vide impugned judgment dated 25.7.2005, acquitted Smt. Shrey Kanwar. However, held the appellants, namely Mool Singh guilty of offence under Section 341, 323/34, 324, 326 and 302 IPC and his son Devendra Singh guilty of offence under Sections 341, 323, 324/34, 326 and 302/34 IPC.
