JUDGEMENT

(1.) WE have heard learned counsel appearing for the parties.

(2.) THIS Special Appeal was filed by the Jaipur Development Authority, with a delay of 1111 days, with an explanation in the application for condonation of delay, that after the writ petition was allowed, instructions were given by the JDA to the then Counsel for the Authority, Shri Sanchit Tamra, to file an appeal, but due to unavoidable circumstances, the appeal could not be filed in time. Certain other appeals on the same issue were allowed in favour of the JDA and thereafter, in the interest of the Authority, Shri Punit Singhvi, Advocate, received instructions to file the present appeal.

(3.) WHEN the matter was taken up today, a request was made to adjourn the matter, as learned counsel appearing for the JDA does not have complete instructions, and the file has been handed over to him only few days before.
