JUDGEMENT

(1.) In this writ petition the petitioner has prayed for the direction to the respondents to grant promotion on the post of UDC on completion of 5 years of regular service on the post of LDC or in the alternative from the date the persons junior to him were promoted on the post of UDC with all consequential benefits. It is also prayed that resolution dated 8.2.1989 laying down criteria for promotion may be declared illegal and order of promotion of the petitioner on the post of UDC dated 8.7.1998 may be quashed to the extent of granting promotion w.e.f. 18.12.1996 and grant promotion after completion of 5 years of service as LDC with all consequential benefits.

(2.) The petitioner was initially appointed as LDC on 3.8.1982 on temporary basis but he was confirmed as LDC vide order dated 27.3.1986. Vide order dated 27.3.1986 4 candidates including petitioner were confirmed w.e.f. 20.6.1985 under the orders of Managing Director Gangapur Cooperative Spinning Mills Ltd.

A provisional seniority list for the post of LDC was issued by the respondent Mill on 23.2.1989 in which the name of the petitioner was included at S.No.2 and his date of appointment was shown as 3.8.1982. After receiving objections, final seniority list was issued by the respondent mill on 11.3.1989 in that also the name of the petitioner was included at S.No.2 and date of appointment on the post of LDC was shown as 3.8.1982.
