(1.) APPELLANTS had submitted an application under Section 34 of the Arbitration and Conciliation Act 1996 (hereinafter, referred to as the Act of 1996) along with an application under Section 5 of Limitation Act 1963 (hereinafter referred to as the Act of 1963) assailing the award dated 30.6.2013 passed by the arbitrator. After passing of the award dated 30.06.2013, an application under Section 34 of the Act of 1996 was filed by the appellants with the prayer to set aside the award dated 30.06.2013 and on 13.01.2014 that application filed under Section 34 of the Act of 1996 was withdrawn by the appellants before the District Judge and so it was dismissed on 13.01.2014 as withdrawn.

THEN after, the appellants gave a second thought to the matter and thought it proper to reagitate the matter and so another application under Section 34 of the Act of 1996 against the award dated 30.06.2013 was filed by the appellants along with an application under Section 5 of the Act of 1963. The application under Section 34 of the Act of 1996 being barred by Limitation was again dismissed by District Judge, Jhalawar vide order dated 23.09.2014.
