JUDGEMENT

(1.) The present second appeal under Sec. 100 CPC has been filed by the daughter of the defendant -Chhotu Lal, who is now represented by his legal representatives, Smt. Pushpa and others, aggrieved by the concurrent decree of possession against them passed by the two courts below.

(2.) The learned trial court of the Civil Judge & Additional Chief Judicial Magistrate, Merta in the order dated 23.05.1985 passed in Civil Suit No. 62/83 - Kalyanmal v/s. Chhotulal, decided various issues in favour of plaintiff -respondent -Kalyanmal, the adopted son of Nathmal in the following manner: - -

(3.) The learned appellate court of the District Judge, Merta dismissed Civil Appeal Decree No. 20/85 - Chhotulal v/s. Kalyanmal filed by the defendant -appellant vide order dated 22.02.1993 with the following findings: - -
