JUDGEMENT

(1.) HEARD learned counsel for the parties. The petitioner is aggrieved against the order dated 3.11.2007 passed by the trial court, where by the application filed by the petitioner under Order I, Rule 10 CPC has been rejected.

(2.) THE respondent -Kheenv Singh filed a suit seeking declaration and injunction against the Municipal Board, Sojat City and the Executive Officer, Municipal Board, Sojat City regarding Plot No. 122.

(3.) THE application was opposed by the respondent -plaintiff on several grounds. It was alleged that the application was mala fide.
