RSRTC Vs. BALCHAND

JUDGEMENT

(1.) This appeal has been filed by the RSRTC against the judgment and award dated 15.10.2005 passed by MACT Neem Ka Thana in Claim Case No. 100/2003. Brief facts of the case are that the claimant filed a claim petition with regard to injuries sustained by him in an accident, which is said to have taken place on 23.10.2002, by RSRTC bus No. RJ 23 P 2220.

(2.) Thereafter notices were issued; reply was filed; certain issues were framed and after hearing all the parties, the learned Tribunal passed the aforesaid impugned judgment and award dated 15.10.2005, decreeing an amount of Rs. 47,500/ - as compensation in favour of claimant.

(3.) Being aggrieved by the aforesaid judgment and award passed by the Tribunal this appeal has been filed by RSRTC.
