JUDGEMENT

(1.) None appeared on behalf of the petitioner even in the second round when the matter was called out.

(2.) Aggrieved of the order dated 5th April, 2006, whereby his claim for appointment on compassionate grounds, has been declined by the State-respondents, the petitioner has instituted the instant writ petition, praying for the following relief(s):

Briefly, the skeletal material facts necessary for appreciation of the controversy, in the instant writ application, are that the mother of the petitioner, died on 28th July, 2005, while she was working on the post of 'Beldar' with the respondent-Department. The petitioner staked his claim for appointment on compassionate grounds on 12th August, 2005. The claim of the petitioner has been declined by the State-respondents vide impugned order dated 5th April, 2006, for the petitioner was not within the eligible age criteria i.e. 40 years as prescribed under Rule 8 of the Rajasthan Compassionate Appointment of Dependants of Deceased Government Servant Rules, 1996 (for short, 'Rules of 1996').
