RAMKUMAR Vs. STATE OF RAJASTHAN AND ORS.

JUDGEMENT

(1.) By way of this writ petition, the petitioner, who is pursuing the studies of B.Ed., is seeking directions to the respondents to take his Teaching Practical Test. The relevant facts are that the petitioner qualified Pre Teachers Entrance Test, 2013 and was admitted to B.Ed. course in Suratgarh B.Ed. College, Suratgarh, which is affiliated to Maharaja Ganga Singh University, Bikaner. It is stated that the petitioner has undergone all examinations and tests conducted by the respondent College such as Micro Teaching, Computer Practical, Seasonal Test etc. It is submitted that the petitioner was not informed about the Teaching Practical Test conducted by the respondents and therefore, he could not appear therein. It is submitted that the petitioner's next B.Ed. Examination is to be conducted on 25.8.14, however, he will not be permitted to appear in the examination if he does not take Teaching Practical Test.

(2.) On 20.8.14, while issuing notices to the respondents, an interim order was passed by this court in favour of the petitioner in the following terms:

A reply to the writ petition has been filed on behalf of the respondent -Maharaja Ganga Singh University, Bikaner as well as the respondent College wherein the petitioner is pursuing studies of B.Ed. course. It is the specific stand taken by the respondent in the reply that it is wrong on the part of the petitioner to say that he was not informed about the Teaching Practical Test conducted. It is submitted that the notice regarding holding of the said test was affixed on the Notice Board. It is stated that as a matter of fact, the petitioner did not undertake any practical work and was not permitted to take B.Ed. Main Examination on account of shortage of attendance. It is submitted that the factum of shortage of attendance of the petitioner and his likes was duly communicated by the respondent College to the respondent University vide letter dated 28.7.14, a copy whereof is placed on record as Annexure -5. The respondent College has also placed on record a photo copy of the application (Annexure -4) submitted by the petitioner showing that the petitioner did not attend the college prior to 5.4.14 and did not undertake the practical work.
