BHAGWATI BAI Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) INSTANT criminal appeal has been preferred by five appellants viz., (i) Bhagwatibai w/o Deendayal (ii) Ghisibai w/o Premnarayan, (iii) Deendayal @ Deenanath s/o Ramcharan, (iv) Bhanwar Singh s/o Premnarayan and (v) Chandraprakash s/o Ramswaroop, respectively under Section 374 of the Code of Criminal Procedure, 1973.

(2.) BY way of instituting instant appeal, all the five appellants have challenged the impugned judgment dated 18.01.2005 rendered by the Additional District and Sessions Judge (Fast Track), Chhabra, District Baran, whereby they were convicted for offences punishable under Sections 147, 452 and 302/149 of Indian Penal Code. However, the appellants have been acquitted of offence punishable under Section 148 of Indian Penal Code.

(3.) THE trial Judge, having convicted all the five appellants, vide a separate order of even date, sentenced them as under : -
