NAUSAD @ SHERU Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Learned counsel for the petitioner submits that the prosecutorix, in her statement recorded under Sec. 164 Criminal Procedure Code.has clearly stated that she had called the petitioner and, thereafter, went away with the petitioner. It is also stated by learned counsel for the petitioner that the charge-sheet has alread been filed against the petitioner and he is in custody since 20.10.2014.

(2.) Heard learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material on record.

(3.) An FIR No.396/2014 has been registered at Police Station, Pratap Nagar, District Jodhpur against the petitioner for the offences punishable under Sections 363 and 366 IPC.
