JUDGEMENT

(1.) Heard the learned counsel for the parties. In this writ petition, the petitioner is challenging the validity order dated 25.05.2015 (Annexure -7) passed by Vikas Adhikari Panchayat Samiti Bilara whereby order has passed to recover amount from the petitioner.

The learned counsel for the petitioner submits that before filing this writ petition, SBCWP No. 12950/2014 was filed by the petitioner in which an order dated 14.05.2014 was passed by this Court that the petitioner may appear before the District Collector -cum -coordinator, Jodhpur or the Chief Executive Officer, Zila Parishad, Jodhpur in the first instance on 26.06.2014 and the District Collector shall pass speaking order after providing opportunity of hearing to the petitioner.

The learned counsel for the petitioner submits that after providing opportunity of hearing, again impugned order has been passed by the District Collector, Jodhpur in very casual manner while observing that the matter is pending before the Jan Lekha Samiti ( ), it is obvious that the matter has not been decided by the District Collector, Jodhpur objectively by speaking order inspite of clear cut directions given by this Court, therefore, the order impugned may be quashed.
