STATE OF RAJASTHAN Vs. SHIV RAJ SINGH

JUDGEMENT

(1.) PETITIONERS- Secretary to the Government, Irrigation Department, Rajasthan, Jaipur and the Chief Engineer, Mahi Project, Banswara - have filed the instant petition praying therein that the award dated 3. 5. 2002 (Annexure P/4), passed by the Tribunal cum Labour Court, Udaipur may be quashed and set aside.

(2.) BRIEF facts giving rise to the instant petition are that Shiv Raj Singh - respondent No. 1 was working as Welder Grade II in the Department of the petitioner No. 2. He filed a complaint before the Labour Welfare Officer and Conciliation Officer, Banswara, stating therein that he was not paid the pay scale of the post of Welder Grade I from January, 1983 to March, 1989 and instead of that, he was given the pay scale of Welder Grade II w. e. f. January 1, 1985.

(3.) THE learned Tribunal, after hearing the parties and examining the documents, accepted the claim of the workman - Shiv Raj Singh (respondent No. 1) by its award dated May 3, 2002.
