ROSHAN @ KLRAN Vs. STATE

JUDGEMENT

(1.) Heard learned counsel for the petitioner and the learned Public Prosecutor for the State and the case diary perused. It is contended that the petitioner is a woman having a small child aged 4 years. It is also contended that she is in custody since 9.9.93 on the charge that 1.55 Grams of smack was recovered from her possession. It is also contended that the petitioner is a bonafide resident of Kota & there is no apprehension that in case she is released on bail, she will repeat a similar offence or she will not be available for trial.

(2.) Taking into consideration all the facts & circumstances specially the fact that she is a woman, I think it proper to release her on bail. It is, therefore, ordered that accused petitioner Roshan @ Kiran w/o Yug Raj Singh be released on bail provided she furnishes a personal bond in the sum of Rs. 5,000.00 (Rupees Five thousand only) stipulation to appear in that court as and when called upon to do so during the pendency of the trial/inquiry/investigation as the case may be against her in the case. The bail shall be subject to the following condition;

(3.) If the aforesaid condition is violated, it shall be open for the trial court to cancel her bail in accordance with law, without making any reference to this Court.
