JUDGEMENT

(1.) Heard learned counsel for the petitioner and the learned Public Prosecutor for the State, after notice to him.

(2.) On the question of presentation of the complaint by the Assistant Public Prosecutor, for the State and the conduct of the case by him, this revision petition deserves to be allowed in view of the decision of this Court in Dhaliya Vs. State of Rajasthan (S.B. Criminal Revision Petition No. 159/78).

(3.) Accordingly, the revision petition is allowed. The conviction and the sentence of the petitioner, are set aside and the petitioner is discharged of the offence u/s 7/16 of the Prevention of Food Adulteration Act. Revision allowed.
