JUDGEMENT

(1.) THIS is a second appeal by the judgment-debtor in execution proceedings.

(2.) RESPONDENT No. I, Ram Ratan, obtained a decree for redemption of mortgage of certain agricultural land against Nand Kishore and Ram Kishan, and the final decree was made on the 5th January, 1949. This decree was put in execution, and the judgment-debtors made an objection that although they were liable to give up possession as mortgagees, yet they were entitled to hold on as tenants, and were protected from ejectment under the provisions of the Rajasthan (Protection of Tenants) Ordinance. The objection was rejected by the two courts below, and one of the judgment-debtors, Nand Kishore, has come up in second appeal.
