JUDGEMENT

(1.) THE question, that has been raised before us, is as to proper court fee to be paid on appeal under sec. 40 of the Displaced Persons (Debts Adjustment) Act (No. LXX) of 1951 (hereinafter called the Act ).

(2.) THE contention of Kishandas appellant is that the fee to be paid is Rs. 2/- only under Schedule II, Art, 11 of the Court Fees Act, while the stamp Reporter contends that it should be under Art. 1, Schedule I of the Court Fees Act.
