JUDGEMENT

(1.) IN both above writ petitions, the petitioners are seeking direction to the respondents to quash the recruitment process of the post of Counsellor and Lab Technician initiated by the Rajasthan State AIDS Control Society and further prayed that the respondents may kindly be directed to conduct fresh selection process for recruitment on the post of Counsellor and Lab Technician as per the rules.

(2.) BRIEF facts of the case are that vide advertisement dated 15.10.2012 (Annex.1), applications were invited by the Raj. State AIDS Control Society, Jaipur for various posts including Counsellor and Lab Technician. The petitioner applied for the post of Counsellor and Lab Technician and they were permitted to appear in the written examination conducted by the respondents on 7.2.2013 being eligible candidates. As per facts, the question papers were put to the candidates in English language only whereas the petitioners are the candidates of Hindi medium. It is also pleaded that in the advertisement, it is nowhere informed to the candidates that the question paper will be given in English language so also no syllabus for the examination was published by the respondents, therefore, the whole process of selection deserves to be quashed and direction may be issued to conduct fresh selection for the post in question.

PER contra, learned counsel for the respondents submits that the contention of the petitioners is totally wrong because along with the writ petitions, the General Instructions (Annex.3) is placed on record in which complete process of selection was disclosed. The petitioners are claiming technical posts of Counsellor and Lab Technician, therefore, obviously, the questions were put in English language and petitioners were declared unsuccessful and after declaring unsuccessful in the written examination, the petitioners are raising grievance with regard to the question paper in English language and for not publishing the syllabus, therefore, they are not entitled to any relief by this Hon'ble Court in this writ petition.
