(1.) The petitioner has come out with the grievance of his appointment on compassionate ground with the Bharat Sanchar Nigam Ltd.

Learned Counsel for the respondent-BSNL submits that vide notification dated 31/ /2008, in exercise of powers conferred by Sec. 14 (2) of Central Administrative Tribunal Act, 1985 (for short, hereinafter referred to as 'the Act of 1985'), Central Government has notified th day of Nov. 2008 as the date on and from which provisions of Sec. 14 (3) of the Act shall apply to the organisations including respondent- Bharat Sanchar Nigam Ltd. as a consequence whereof, orders passed by the Bharat Sanchar Nigam Ltd. are challengeable before Central Administrative Tribunal under the Act of 1985.

As per Sec. 29, Clause (2) of the Act of 1985, every suit or other proceedings pending before a Court or other authority immediately before the date with effect from which jurisdiction is conferred on a Tribunal in relation to any local or other authority or corporation or society, being a suit or proceeding the cause of action whereon it is based is such that it would have been, if it had arisen after the said date, within the jurisdiction of such Tribunal, shall stands transferred on that date to such Tribunal.
