JUDGEMENT

(1.) There is delay of 40 days in filing the instant appeal, for which an application u/s. 5 of Limitation Act has been filed, for the reasons assigned in the application duly supported by affidavit, I am satisfied that the delay caused in filing the appeal has been explained satisfactorily and the application for condonation of delay is allowed and the delay stands condoned.

(3.) The instant appeal is directed against order of the Tribunal dated 1.8.2008 passed in claim petition No.194/2008.
