JUDGEMENT

(1.) In criminal case No.83/1988 titled as State V/s Baldeo Singh, accused-petitioner Baldeo Singh was convicted on 22.06.1994 by the court of Additional Chief Judicial Magistrate, Srikaranpur District Sriganganagar under section 3/25 of Arms Act, 1959. Accused-petitioner Baldeo Singh filed an appeal and his criminal Appeal No.55/1994 was decided by the Additional Sessions Judge No.3 Sriganganagar Camp at Srikaranpur on 21.03.1997 and by partly accepting his appeal had convicted and sentenced him as follows:-

(2.) In this Criminal Revision Petition, the accusedpetitioner Baldeo Singh has not challenged his conviction under section 3/25 of the Arms Act, 1959 but he has prayed for only for the benefit of probation. He has relied upon the following ruling:-

(3.) In this case, the accused was not previously convict and he was in Jail for one and half month. In the circumstances of case, in an offence relating to possession of a country made pistol, he was released on probation on good conduct.
