JUDGEMENT

(1.) Heard.

(2.) The present petition under Sec. 482 Crimial P.C. has been filed by the petitioner praying that the order dated 31st Oct., 2013 passed by Additional Chief Metropolitan Magistrate, (Communal Rites Cases), Jaipur Metropolitan whereby the application filed by the petitioner under section 70(2) Crimial P.C. has been rejected, be set aside.

(3.) Counsel for the petitioner during the course of arguments has submitted that the petitioner is being prosecuted for offence under Sec. 138 of the Negotiable Instruments Act which is a non-cognizable and bailable offence. Counsel for the petitioner further submitted that the petitioner is ready and willing to surrender before the trial court and apply for bail.
