JUDGEMENT

(1.) HEARD learned counsel for the appellant - the driver cum owner of the offending vehicle and learned counsel for the respondents/claimants.

(2.) THE instant appeal is preferred by the appellant against the judgment dated 27.11.2006 passed by the learned Additional District Judge (Fast Track) No.6 (Motor Accident Claims Tribunal), Udaipur in Claim Case No.531/2005 (317/2004) whereby whilst accepting the claim application filed by the claimants/respondents, the appellant was held liable to pay a total compensation of Rs.2,65,000/ - to the claimants/respondents with an interest of 6% per annum from the date of institution of the claim application.

(3.) ON considering the reasons mentioned in the application, the delay of 8 days in filing the appeal is condoned. The application is allowed accordingly. The appeal is heard on merits with the consent of the learned counsel for the parties.
