JUDGEMENT

(1.) The matter today comes up on an application being I .A. No. 2963/2013 filed by the learned Counsel for the respondent No. 5 seeking vacation of the ad interim ex parte stay order dated 10.12.2010 granted by this Court in favour of the appellant.

(2.) With the consent of the learned Counsel for the parties, the matter is heard finally.

(3.) The instant misc. appeal is directed against the order dated 21.10.2010 passed by learned Additional District judge No. 1, Bhilwara in Civil Misc. Case No. 89/2008 whereby, the application preferred by the appellant plaintiff under Order 39 Rule 1 and 2 C.P.C. for grant of temporary injunction was rejected.
