These two petitions relate to transfer of students admitted in academic years 2010-11 and 2011-12, in the four years B.Tech course in various branches Civil Engineering, Computer Science Engineering, Electric and Communication Engineering, Electric Engineering and Mechanical Engineering to the petitioner Regional Engineering College village Dhamotar, District Pratapgarh. The said college was recognised for the said courses by the All India Council for Technical Education (AICTE) and affiliated with the Rajasthan Technical University Kota (RTU).
(2.) It appears that for reasons of inadequacy of students in various approved engineering branches, the college in issue sought permission from the AICTE to altogether discontinue its four year B. Tech Programme. AICTE required the petitioner college to first obtain a No Objection Certificate (NOC) from Rajasthan Technical University i.e. the RTU the affiliating university. The petitioner college then approached RTU and vide letter dated 9/10-2-2012 this was allowed subject to the condition that the petitioner college ensure requisite funds and infrastructure such as laboratory, library, computers faculty for those students who had already been admitted to academic sessions 2010-11 and 2011-12 in its various branches of the four year B. Tech programme and other students with back papers till they completed their course. All regulations of the RTU were to be followed in the meantime. Following the NOC granted by the RTU, vide order dated 22-1-2013 AICTE allowed progressive closure of B. Tech programme. This progressive closure entailed no new induction of students in future years for the four year B. Tech programme, but the petitioner college was under an obligation to continue providing requisite infrastructure and facilities as per the conditions of recognition of the courses by the AICTE and affiliation by RTU.
(3.) A sudden inspection of the petitioner college was then conducted by RTU, as the affiliating university, on 20-10-2012 and following lacunae/ breaches of the conditions of NOC for closure by RTU were found:-
