JUDGEMENT

(1.) Present application has been filed under Sec. 439 Crimial P.C. for grant of regular bail to the petitioner in a case arising out of F.I.R. No. 823/2013, registered at Police Station, J.D.A. Jaipur Metropolitan City, Jaipur, for commission of offence punishable under Sec. 420 I.P.C.

(2.) The learned counsel appearing for the petitioner has submitted that it is alleged by the complainant that the petitioner having sold his plot by way of agreement to sell on 17.12.2012 to one Laduram had again executed an agreement to sell with the complainant on 18.06.2013 and had received INR 4,81,000.00, as an earnest money.

(3.) Counsel appearing for the petitioner has further submitted that in fact the petitioner had issued a cheque, which had bounced for which notice under Sec. 138 of the Negotiable Instruments Act has also been issued by the complainant.
