JUDGEMENT

(1.) THIS Criminal Misc. Petition under Section 482 Cr.P.C. has been filed by the petitioners with a prayer for quashing the FIR No.15/2014 dated 15.01.2014 of Police Station, Mandore, District Jodhpur, for offence punishable under Sections 406, 420, 467, 468, 471 and 384 IPC.

IN the instant case the respondent No.2 mother of the petitioner No.1 and mother -in - law of petitioner No.2 has filed a complaint in the Court of Metropolitan Magistrate No.5, Jodhput Metropolitan, with a allegation that in the year 2012 when she went for her knee treatment at Ahmedabad she handed over certain documents pertaining to her property to the petitioners. After her treatment when she demanded the said documents from the petitioners they have refused to return the same and prepared some forged documents with the intention to grab the property. It is also alleged in the complaint that the petitioner No.2 has threatened them with the dire consequences in case she files any complaint. Allegations regarding preparation of forged documents for the purpose of transfer of gas connection which was in the name of her husband, has also been levelled in the complaint.

(3.) LEARNED counsel for the petitioners has argued that in fact the respondent No.2 has filed the complaint against the petitioners at the instance of her son Mahendra Singh and her daughter -in -law Lalita. It is also alleged that civil litigation is pending between the parties in relation to the property, therefore, the FIR may kindly be quashed.
