The petitioner by way of present petition has sought relief against the respondents to call for the record and declare the acts and omission of the respondent No.3 to be illegal, arbitrary and irrational, and further to direct the respondent No.3 to provide the appointment to the petitioner on the post of Data Entry Operator with all consequential benefits.

As per the case of the petitioner, he had applied for the post of Data Entry Operator pursuant to the advertisement dated 05.10.2012, he being qualified for the said post, however the petitioner was not given appointment. The learned counsel Mr. Resham Bhargava for the petitioner submits that the petitioner is holding the certificate, Annexure/2 from Shramik Vidyapeeth, Ajmer, which is established by Ministry of Human Resource Development, Department of Education Government of India, New Delhi, and therefore the said certificate should be treated as diploma as per the dictionary meaning given in the Advanced Law Lexicon by P. Ramanatha Ayyar.

At the outset it is required to be mentioned that the relief claimed by the petitioner in the writ petition is too vague, inasmuch as the petitioner has not specified as to which act or omission of the respondent No.3 is required to be declared illegal, arbitrary and irrational. That apart, it appears that as per the qualification prescribed in the advertisement Annexure/4, for the post of Data Entry Operator, the candidate has to hold diploma in computer science/computer applications of a University established by law in India or from an institution recognised by the Govt. or from the institution recognised by the Govt., amongst other educational institutions. The petitioner has relied upon the certificate with regard to his participation in computer training programme held by Shramik Vidyapeeth, Ajmer. The said institution might be an institution established by the Government, however the certificate issued is with regard to petitioner's participation in a computer training programme, and the same does not pertain to the diploma in computer science/computer applications. The dictionary meaning relied upon by the learned counsel for the petitioner, reads as under:-
