JUDGEMENT

(1.) THE instant writ petition has been filed by the petitioner for seeking direction to the respondents to grant 16 marks prescribed for the State Level Certificate Annexure -4 and placed his name in the merit accordingly for recruitment on the post of Physical Teacher Grade -III.

AS per facts the petitioner applied for the post of Teacher Grade -III in pursuance of the advertisement issued by the RPSC dated 14.12.2011 and claimed appointment on the basis of certificate of Games (Annexure -4) which is issued by the Rajasthan State Kabaddi Association for participation in the Kabaddi Tournament at Karauli from 12.4.1998 to 15.4.1998.

LEARNED counsel for the petitioner vehemently argued that the respondents cannot deny 16 marks for the certificate Annexure -4 because the petitioner has participated in the said State Level Tournament conducted by the Rajasthan State Kabaddi Association in the session 1997 -98 which is State Level Association affiliated to the Amature Kabaddi Association of India, therefore, in view of the judgment rendered in case of State of Raj. Vs. Umesh Jangid, the petitioner is entitled for the marks prescribed for the certificate for recruitment on the post of Physical Teacher Grade -III.
