JUDGEMENT

(1.) Affidavit filed by the petitioner is taken on record.

(2.) Heard the learned counsels for the parties.

(3.) The petitioner-defendant has filed the affidavit on oath stating interalia that he will vacate the premises in question on 01.07.2014, and will hand over the vacant possession of the premises to the respondent or his representative/s. However, the learned counsel Mr. Rajvir Sharma for the respondent has submitted that the petitioner has not paid the mesne profits @ Rs.500/- per month, though directed by the trial court while passing the decree, and the arrears of mesne profits come to more than Rs.30,000/-. The learned counsel Mr. Sajid Ali for the petitioner, however submits that the petitioner is very poor, and is not in a position to deposit such a huge amount.
