JUDGEMENT

(1.) THE instant writ petition has been filed by the petitioner for direction to the respondents to consider his case for appointment on the post of Assistant Public Relation Officer as per her merit and to quash the communication dated 13.12.2013 (Annexure -15) issued by the Raj. Public Service Commission. Further it is also prayed that the diploma qualification of the petitioner may be declared valid for the purpose of appointment on the post of Assistant Public Relation Officer and in case the petitioner could not secure her appointment on the post of Assistant Public Relation Officer on the basis of diploma qualification acquired from the Prans Media, the respondent No.4 Prans Media may be held liable for consequential damages to be paid to the petitioner.

AS per facts of the case, the respondent Commission issued advertisement dated 20.1.2012 whereby the applications were invited for various posts including the post of Assistant Public Relations Officer. In all 34 vacancies were advertised and petitioner treating herself eligible for the post applied. According to the petitioner, she is possessing graduation and diploma course in TV Anchoring and News Reporting from Prans Media, therefore, after due satisfaction with regard to eligibility, the respondent Commission called the petitioner for interview, which was held on 01.04.2013.

LEARNED counsel for the petitioner submits that after recommendations of the name, the petitioner was waiting for appointment order but no appointment order was issued in favour of the petitioner then the petitioner by the Government. The petitioner submitted a representation to the Additional Director, Department of Information and Public Relation, Jaipur and prayed for providing appointment on the post of Assistant Public Relation Officer. All of sudden, a communication dated 13.12.2013 received by the petitioner from the respondent Commission in which it was informed that his selection on the post in question has been cancelled for the reasons that you have acquired diploma from the Prans Media Institute in TV news, anchoring and reporting but Punjab Technical University informed that the Prans Media Institute is a learning centre and not authorized for diploma course. Being aggrieved and dissatisfied with the said communication dated 13.12.2013, the petitioner has preferred this writ petition to challenge the above order.
