JUDGEMENT

(1.) THE appellant -Insurance Company has preferred this Civil Misc. Appeal under Section 173 of the Motor Vehicle Act, 1988 passed by Judge, Motor Accidents Claims Tribunal, Chhabra (District Baran) in Claim Case No. 97/2010 whereby the Tribunal by allowing the claim petition filed by the respondent -claimants has awarded a total amount of Rs. 8,88,400/ - with interest in an accident case in which one Shri Dharmraj died.

(2.) A perusal of award shows that the income of the deceased was assessed as Rs. 3,600/ - per month and looking to the age of the deceased at the time of accident multiplier of 17 was applied.

(3.) CONSEQUENTLY , the appeal being meritless is, hereby, dismissed at the admission stage itself. The stay application also stands dismissed.
