JUDGEMENT

(1.) THIS misc. petition u/s. 482 Cr.P.C. has been filed for quashing of criminal proceedings pending before the court of learned Additional Civil Judge (Senior Division) No. 4, Jaipur Metropolitan in Case No. 360/2012 (State Vs. Sita Ram) for offence under Section 498 -A IPC.

(2.) THE facts giving rise to the filing of this petition in brief are that marriage of the petitioner -husband and respondent No. 2 -wife was solemnized at Jaipur according to the Hindu rites on 14/04/2008. After marriage, their marital relations got strained to the extent that respondent No. 2 lodged first information report against the petitioner for offence u/ss. 498A & 406 IPC. However, during the proceedings pending before the court below, they entered into a compromise on 02/05/2014 and submitted it with the joint application to the court below for attestation of the compromise for offence u/ss. 498A & 406 IPC. The learned court below though acquitted the petitioner from the charge of offence u/s. 406 IPC but declined to attest the compromise for offence u/s. 498A IPC and framed charge against him for the said offence. Hence, this petition for quashing of the criminal proceedings pending before the court below and for attestation of compromise for offence u/s. 498A IPC.

(3.) IN view of the above, petitioner -Sita Ram Saini (husband) and respondent No. 2 -Smt. Sita @Roshani (wife), who are present in court jointly prayed for quashing of the criminal proceedings pending before the court below and for attestation of compromise for offence u/s. 498A IPC. They have appended their respective signatures on the order -sheet of the file and they have also been identified by their respective counsel in the court today.
