SUNIL KUMAR Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) I have heard learned counsel for petitioner Sunil Kumar, learned PP for the State and have also perused the police papers placed before me.

(2.) Petitioner Sunil Kumar having been born on 16.7.89, is a Juvenile, whereas as per the medical examination report of prosecutrix, she is between 16-20 years.

(3.) Considering the submissions, the nature of accusations, the materials on record and all other facts and circumstances of the cases and following the precedent in the case of Shankarlal Meena Vs. State of Rajasthan, reported in 2000 Cr.L.R. Raj. 173 , I deem it just and proper to enlarge the petitioner on bail.
