GOVIND RAM Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) HEARD learned Counsel for the panies and perused the papers made available to me on record and the case diary cross F.I.R. has been lodged by the accused sualal that an attempt was made for committing rape on his wife by deceased Moti Ram. A perusal of the case -diary also indicates the circumstances that the villagers inflicted injuries on the person of the deceased when after taking drinks he went in search of a lady and he attempted rape on the wife of the accused. In this view of the matter, I am inclined to grant bail to the accused. The out expressing any opinion on the merits of the case and looking to the facts and circumstances of the case, I am inclined to accept this bail application under section 439, Cr. P.C. It is, therefore, ordered that the accused petitioner(s) Govind Ram, Sardara, Kurda Ram and Suwalal r/o Belwad P.S. Khandela Distt. Sikar shall be release on bail, provided each one of them furnishes a personal bond in the sum of Rs. 10,000/ - thousand (Rs. Ten thousand) the two sureties in the sum of Rs. 5,000/ - each to the satisfaction of the learned trial Court for their appearance on all subsequent dates of hearing and as and when called upon to do so.
