JUDGEMENT

(1.) We have heard learned counsel for the applicant- petitioner Swaroop Singh and the learned Public Prosecutor.

(2.) Keeping in view the circumstance that disposal of the appeal is likely to take a long time and the fact that the applicant's wife had expired and all the children of the applicant are minor and there is no one to look after the interest of the minors, which fact is verified by the learned Public Prosecutor, we deem it proper to suspend the sentence awarded against the applicant-petitioner and enlarge him on bail.

(3.) We, therefore, direct that in case applicant-petitioner Swaroop Singh furnishes a personal bond in a sum of Rs. 20,000.00 and two surety bonds in a sum of Rs. 10,000.00 each to the satisfaction of the learned Addl. Sessions Judge, Barmer for appearance before this Court as and when called upon to do so, he may be enlarged on bail, provided he is not required in any other case.
