JUDGEMENT

(1.) THIS is the third bail application on behalf of accused -petitioners Ummed Singh and Shoo Singh. The second bail application filed on their behalf was rejected on 11.1.1993. While rejecting the second bail application, it was left open for the petitioners to approach this Court again after the concerned Doctor is examined. Shri Naqvi submits that the concerned Doctor has now been examined. The Doctor has categorically stated that the injury on the head was the result of single blow. Addl. Public Prosecutor has gone through the statement of the Doctor and he does not dispute the statement of Shri Naqvi. The accused -petitioners are said to be in jail since August, 1992. In the facts and circumstances of the case, I am inclined to accept this bail application under Section 439, Cr. P.C. to the accused -petitioners.

(2.) IT is, therefore, ordered that the accused petitioners (1) Ummed Singh s/o Narayan Singh and (2) Sheo Singh s/o Narayan Singh, r/o Salempur, P.S. Salempur, District Sawaimadhopur be released on bail provided each of them furnishes a personal bond in the sum of Rs. 10,000/ - (Rupees ten thousand) with two sureties of Rs. 5,000/(Rupees five thousand) each to the satisfaction of the trial court to appear before it as and when called upon to do so during the pendency of the trial against them. Application allowed.
