JUDGEMENT

(1.) THIS is an appeal by the accused Kabulsingh against the judgment of the learned Additional Sessions Judge, Ganganagar, dated the 10th December, 1951, by which the appellant was convicted of an offence under sec. 304 of the Penal Code and sentenced to five years' rigorous imprisonment.

(2.) THE only question for determination in this appeal is whether the accused Kabulsingh exceeded his right of private defence.
