JUDGEMENT

(1.) The instant misc. petition under Sec. 482 Cr.P.C. has been filed by the petitioner against the order dtd. 21/10/2023 passed by learned Additional Chief Judicial Magistrate, Raisinghnagar, District Sri Ganganagar in criminal case No.205/2012 titled as 'Tarachand Vs. Vijay Singh Kulhari' whereby, the learned trial court below issued arrest warrant against the petitioner. Learned counsel for the petitioner makes a limited prayer that the petitioner is ready and willing to appear before the learned trial court and therefore, warrant of arrest so issued against the petitioner, may be converted into the bailable warrant. Per contra, learned Public Prosecutor opposes the prayer of the petitioner.

Having heard and considered the submissions advanced and after carefully perusing the material available on record, this Court is of the opinion that the arrest warrant issued by the trial court against the petitioner shall be converted into bailable warrant in the sum of Rs.50,000.00. It is further directed that if the petitioner appears before the trial court within a period of '15 days' and submits the bail bonds of Rs.50,000.00, the trial court shall release the petitioner on bail. However, it is made clear that in case, the petitioner does not appear before the trial court within the stipulated time frame, the trial court shall issue warrant of arrest against the petitioner. The instant misc. petition is allowed with the above directions. Stay petition also stands disposed of.
