The present interim bail application under Sec. 439 Cr.P.C. has been filed by learned counsel for the petitioner on the ground that petitioner's father namely Vishala Ram Sarvag passed away on 12/2/2023 in a road accident, therefore, he may be granted the interim bail application so as to perform last rites and rituals of his late father. This Court vide order dtd. 21/3/2023 directed learned Public Prosecutor to verify the fact regarding death of the petitioner's father.
(2.) Learned Public Prosecutor submitted that father of the petitioner passed away on 12/2/2023. He further submitted that no case for grant of interim bail is made out since almost two months have passed from the date of the alleged incident and all the rites and rituals as per the Hindu religion have already been performed and, therefore, presence of the petitioner is not required for the same. In view of the above facts, so also the fact that two months have already been passed from the date of the alleged incident and all rites and rituals have already been performed, I am not inclined to release the petitioner on interim bail.
(3.) Accordingly, the present interim bail application under Sec. 439 Cr.P.C. is dismissed.
