JUDGEMENT

(1.) The instant appeal has been filed under Sec. 14A(2) SC/ST (Prevention of Atrocities) Act on behalf of the appellant, who is in custody in connection with FIR No.165/2023, Police Station Balesar, District Jodhpur, for the offences under Ss. 153-A, 295-A, of IPC and Sec. 67, 67-A of the IT Act and Ss. 3(1)(r)(s)(v) of the SC/ST (Prevention of Atrocities) Act, being aggrieved by the order dtd. 18/10/2023 whereby the application under Sec. 439 of the Cr.P.C. has been rejected by the trial Court.

(2.) It is submitted by learned counsel for the appellant that he has nothing to do with the alleged offence, therefore, benefit of bail may be granted to the appellant.

(3.) Per contra, learned learned Public Prosecutor opposed the bail application.
