JUDGEMENT

(1.) HEARD learned counsel for the parties.

(2.) VIDE order dated 28th May, 2004 (Annex.A/2), the respondents passed an order against petitioner directing him to deposit a sum of Rs.6,16,184/-. Out of this amount, a sum of Rs.1,74,878/- was deducted by the respondents from gratuity amount of the petitioner and directed to deposit the remaining amount of Rs.4,41,306/- with the Railway at an early date so as to close the case. Being aggrieved with the aforesaid order, the petitioner filed original application before the Central Administrative Tribunal, which has been dismissed, hence, petitioner has preferred this writ petition.

(3.) LEARNED counsel for petitioner submitted that order dated 28th May, 2004 is without jurisdiction, he served a notice of demand of justice dated 21st October, 2004 before filing the original application before the Tribunal, but no heed was given to the said notice, therefore, he preferred original application directly before the Tribunal.
