(1.) THIS matter was to be taken up on 15.07.2013 but has been taken up today for non-availability of this Bench earlier.
(2.) DURING the course of submissions today, it has been pointed out that the earlier incumbent holding the post of DCP (Traffic) has since been transferred and new incumbent has joined. Upon this Court expressing reservations about any such transfer having been ordered, the learned Additional Advocate General submits on instructions that in fact, the Collector chairing the Monitoring Committee had to express his reservations for non-execution for all the requisite tasks and, therefore, in order to ensure compliance of the orders of this Court for proper traffic management, a new officer has been posted, who has joined on 16th inst. Though we have reservations on any officer related with this matter having been transferred without bringing the fact to the notice of the Court but then, looking to the circumstances as stated, as also having regard to the comments made in this matter on earlier occasions, we would not like to make any further comment in this regard at present.
(3.) HAVING regard to the submissions made by the learned Amicus Curiae as also the learned Additional Advocate General and the learned counsel appearing for the Municipal Corporation, Jodhpur, we are constrained to observe that the requisite seriousness for execution of all the work, that was shown for some time in the past seems to have waned. Obviously, such a position, cannot be accepted.
