INSTANT writ petition has been filed by the petitioner to quash order dated 11.01.2012 (Annex.- 9) and order dated 16.02.2012; and, further, for directions to the respondents to consider his case for appointment as per his merit on the post of Junior Accountant at par with other candidates given such appointment vide order dated 16.05.2012. It is also prayed that the respondents may be directed to treat the petitioner within age limit as per para 6(6) and para 6(15) of the advertisement dated 09.09.2008.

ACCORDING to the case, the petitioner was provided appointment on the post of L.D.C. through regular process of selection on 23.09.2002 but in the appointment order it was observed that appointment is temporary. The post of L.D.C. was later on re- designated as Junior Judl. Assistant. The petitioner is working on the post of Junior Judl. Assistant since his appointment and, in pursuance of the advertisement issued by the respondent Rajasthan Public Service Commission for the posts of Junior Accountant/Accountant/Tehsil Revenue Accountant. The petitioner being eligible for the above post applied to participate in the said competitive examination. For appearing in the above examination, the petitioner sought no-objection certificate from the Rajasthan High Court and, thereafter, appeared in the examination.

THE present employer of the petitioner viz., the Rajasthan High Court granted Assured Career Progression in pursuance of Rule 19 of the Rajasthan Civil Services (Revised Pay Scale) Rules, 2008 and Government notification dated 31.12.2009. After passing the written examination for the post of Junior Accountant a communication dated 11.01.2012 was received by the petitioner from the RPSC narrating therein that upon scrutiny of documents you have been found over-age, therefore, your candidature is hereby cancelled.
