JUDGEMENT

(1.) IN this petition filed as a Public Interest Litigation ('PIL'), the petitioners, who are the agriculturists of different villages of District Jalore, have voiced the grievance that though the land held by them was recorded as irrigated/Nahari land in the old Jamabandi and revenue records but came to be recorded as Chahi after the settlement.

(2.) IT is submitted that the concerned authorities made the communications conveying that the change of revenue record had been for the mistake of the settlement department. It is further submitted that the Superintending Engineer wrote to the District Collector, Jalore on 30.08.2008, for providing water from the Jawai Dam to the petitioners and other land -holders whose land had mistakenly been entered as uncommand land, which was supposed to be the command land.

(3.) A communication dated 16.11.2011 (Annex.12) sent by the Divisional Commissioner, Jodhpur to the Addl. Chief Secretary, Water Resources Department, Government of Rajasthan has also been referred, the contents whereof are as under: - ...[VERNACULAR TEXT OMMITED]...
