(1.) HEARD Mr.S.S.Sisodia, learned counsel appearing on behalf of the petitioner and Mr.V.K.Mathur and Mr.Tarun Joshi, learned counsel for the respondent.
(2.) THE pleaded version of the petitioner is that in response to the advertisement for recruitment to the Rajasthan Judicial Service, he being eligible in terms thereof, offered his candidature whereafter the Rajasthan Public Service Commission (for short hereinafter referred to as "the Commission") allowed him to participate in the R.J.S. Main Examination 2011 held in March,2013. He duly undertook the said examination. The results were declared on 14.6.2013 wherein the petitioner was declared unsuccessful. He thereafter sought certified copy of answer sheets of Law paper I & II along with marks alloted, but the same was turned down by the Commission.
(3.) THE further case of the petitioner is that on the previous occasion also, he had sought such information from the Commission on 10.6.2010 with regard to R.J.S. Examination 2005 but his request for providing copy of answer sheets was not acceded to. Aggrieved thereby, he appealed before the appropriate forum but he was not allowed to have access thereto. He then filed a second appeal before the Chief Information Commissioner, who after due consideration directed the Commission to provide a copy of the answer sheets to the petitioner but since those had been weeded out by them, he could not be furnished the same. He has, therefore, prayed that a writ, order or direction be issued to the Commission not to weed out the answer sheets of the petitioner of the R.J.S. Examination 2011 by way of interim relief and further to provide the certified copies of evaluated answer sheets of the petitioner as aforementioned.
