(1.) We have heard Mr. B.C. Mehta, learned counsel for the appellants and perused the judgment of the learned Single Judge.
(2.) Fakir Mohd. filed a writ petition before this Court seeking direction to treat him continue in service and to pay all retirement benefits admissible at the time of his retirement. The learned Single Judge found that his case was squarely covered by a decision of this Court dated 27th July, 1992 rendered in Shaitan Singh v. The State of Rajasthan and Another, S.B. Civil Writ Petition No. 890 of 1989. In the said case the learned Single Judge in view of the provisions of Rule 192 of the R.S.R. held that the service rendered by petitioner in Chamble project was liable to be taken into consideration for the purpose of pension.
(3.) On careful consideration of the facts of the instant case and that of the Shaitan Singh's case, we are of the view, that the learned single Judge rightly held that the case was squarely covered by the earlier decision of this Court.
