JUDGEMENT

(1.) HEARD learned counsel for the parties.

(2.) THIS is a second appeal of the plaintiff-landlord against the judgment and decree of the First Appellate Court dated 4th April, 1998 by which the First Appellate Court allowed the appeal of the defendant Hurmat and dismissed the suit of the plaintiff by judgment and decree dated 4th April, 1998.

(3.) THE defendant No. 1 submitted written statement and denied the plaint allegations and claimed that she is owner of the property and there is no relationship of landlord and tenant between the plaintiff and the defendant No. 1 nor she is in occupation as tenant.
